It was a statement and it could have been resolved with a "hey, watch your language in the chat yeah because that kind of stuff isn't tolerated here and next time you'll be muted". I really doubt anyone is disputing whether it's a nice thing to say but it's just a shitty move to instantly punish someone for that. Also excusing anything you've said because you're bisexual is cool and all but isn't it a thing that gay people can't say the f slur which they've reclaimed (maybe not the correct term I don't remember) and black people can't say the n word so why are you supposed to just be allowed to go against the discrimination policy you just mentioned yourself when I guarantee any other bi or gay people wouldn't I fully agree with you - I just want to clarify, I am not in any way shape or form saying that someone should be banned for 8 weeks for this alone. In this case, I can only assume Dutch made this decision based on Miss Legend's rapsheet, on which she does have a past history of discriminatory behaviour. As I said in my previous post, for a minor thing like this, usually a verbal warning would suffice, but when it is consistently done, it does add up (like how if someone RDMs once, they'll likely get a verbal or be told to be careful, but if they do these "little" things lots, they're going to end up with a ban for it). I also agree with you on the second part, I think you may be misunderstanding me slightly here - within ZARP, discrimination in any way shape or form is not allowed. In person, around my gay friends and family members, a joke about being gay with the appropriate context (typically aimed at myself) is (in my opinion, and the friends I would ever make such jokes around) okay, but within ZARP of course it's not allowed, such language or jokes aren't permitted under the Terms of Use, and so even if someone who is affected is okay with such jokes or language, it's still punishable on our services (this is largely to prevent loopholing and due to the fact that when people don't know each other very well, as is the case online, such things lose the "humour" aspect and end up becoming just offensive - my wording on this bit may not be the best, but I think it gets across the point I'm trying to make properly). Since a lot of people seem to find it funny to continue joking on the subject and making inappropriate comments, I'll be locking this appeal until Joshua wants to post the verdict. I have reviewed this warning appeal in detail and discussed it with other members of the leadership team and CM team members. I have had the logs downloaded and checked for around this time also. I have reviewed and thought about this appeal for over 2-3hours thinking how I’m going to deal with this appeal to ensure that both sides are happy with the outcome; however, after re-reading the Discrimination policy over again to recap myself for any recent changes(should there be any) I have spoken with XDutchCat about this appeal also, along with Xnator, we have come to a decision that we are going to be denying this appeal based on your recent punishments around this topic and how you have reacted on the forums based on Xnator's replies when discussing the LQBT+ Community. Discrimination around the LBQT+ Community will not be tolerated inside ZARP at all. Regarding the eight weeks ban mentioned in-game, I have discussed this with XDutchCat, and we would not ban for eight weeks just based on this incident alone; it would be a collection of incidents should it continue to happen. I would suggest re-reading over the TOS, Discrimination Policy, and SSRP Rules to ensure that you do not break any further rules or policies and avoid the potential that you will be banned. Josh |
