There are ways to die in the night club. Passive mode automatically engages about 20 seconds after you enter the night club as long as you don't have a hit on you, are wanted, etc. Entering passive mode is indicated by a small text popup in the top right corner of your screen (below the current song). Are you sure that you entered passive mode and if so, do you have any evidence of this (preferably video evidence)?

From what Martin said, you will need more proof than this for us to help you, you should get passive mode in the first 20seconds when you enter the Night club, unless you can gather more proof, this is therefore denied.
