Passive mode automatically engages about 20 seconds after you enter the night club as long as you don't have a hit on you, are wanted, etc. Entering passive mode is indicated by a small text popup in the top right corner of your screen (below the current song). Are you sure that you entered passive mode and if so, do you have any evidence of this (preferably video evidence)?
