Story - I was walking and I see a car so I ran to the side walk then he turns on me just so he can run me over

i think he aimed for gas station, since at the last seconds he's trying to get gas. i dont know, this is debatable though.

Ur still on the road though as i wouldn't really say as gas station drive through is the sidewalk

This was not CDM, he was aiming for the gas station and you were still on the road.
At the last second he was fueling up his car.
