It's doesn't matter if he failed, he still tried.

You can look at it as murder. It doesn't matter whether your bullet killed him or not, you were still trying to kill him. You can't just evade going to jail by saying: "Well, I didn't actually kill him, I only tried to. But since I didn't succeed, this case is completely invalid."
