Surely if they attempted to cdm you it is allowed to retaliate so him clearly trying to cdm makes it fine for him to kill you so he wasn't ignoring rdm

Nope, that was one of the problems caused before the "rule change", the thing is Emmit wasn't even hit, also if you were hit, even if you lost 1HP, it was apparently valid to kill the driver. Now you know why it was changed.
