There was no point in banning him, as the person he directed it towards (me) did not take offence to the remarks he made.

No one was offended by the racism before you joined, meaning there is no real point in "enforcing" the TOU. If it's just a bit of fun, why ban him for it?

You unbanned him after that incident, and when he was back he said "Can I be racist" and that lead to you banning him. If it was really about the situation before, why not just leave him banned?

So if I understand you correctly you are ok with racism in this community ? Especially as a staff member??
