Ok let me clear this post up real quick, Now take in to consideration that this is just one side of the story and there could of been more factors in lnvolved but for now we will take it as face value.

If someone is in your car you're allowed to kill them your car = your property. There is no I'm just moving it or I was just looking, testing or bringing it back excuse. You're allowed to shoot on site if someone is in your car it is considered stealing and in "RP" and "Semi-Serious" standards that's what it would be counted as.

Side Note: You CAN NOT ask someone to get in your car and then kill them or any other trick to get them in the car so you can kill them that will be counted as RDM and treated as a rule break.
