The way you're shooting around him is clearly targeting and a valid reason for him to kill you, if someone was shooting a gun at your feet in real life, wouldn't you consider that quite hostile? It doesn't matter if you miss, purposely or not, and its surely not his responsibility to figure out that you are shooting at him for fun.
