The idea of Bilbo is to take into account that there is a witness to the crime you're about to commit. Is there a NPC or player near you and your victim? Then you're no long allowed to carry out your mugging or other crime, as there is a witness to your crime. If you continue your law breaking activity you are breaking rule 3.2 because you are now risking your life.
If I were to mug.. lets say bilbo. I would have to do this in a small ally or empty street as there are no witnesses to my crime, and would mean I am not "endangering" my life. If I were to mug bilbo in a empty burger king with an employee present (NPC), I wouldn't do it since the person will be a witness to my crime and that would mean i am "endangering" my life. Something that is forbidden in the rules.
I think your suggestion is good, and I will be sure to bring this suggestion onto our to-discuss list.
