When it comes to warnings one isn't worse than the other unless it was something like ddos threats to nlr but it depends on the story. If he knew he was breaking nlr and still did it that's worse than rdming someone on accident and being knew to the game mode and didn't know if it was acceptable to kill the other player or not.
