Ok, here's the thing, he broke a rule, that's clear to everyone. But the question we all ask ourselves is IF he had had mentoring and had been taught the ropes, would he have done the things he did? Probably not, yet there is no way to tell. You can't expect someone to roll up, with no prior moderating experience, pay for mod, then go out into the busy, populated server and do a good job. These people should be taught the ropes, they should be assigned a teacher to show them what is wrong and what is right, they should be monitored in the early stages of their career as moderator.
So, to sum up, I think he should not get a warning, but be monitored and taught how to do things before he is let out into the field.
