You don’t have any evidence of this occurring, but both stories are plain RDM. On story 1, did you ask BrokeN why he was shooting at people and possibly killing them? If not, then RDM. If you did ask him and he didnt reply, then it’s not RDM.

Story 2, killing on suspicion. That was indeed RDM. T-Rex started shooting at you which is fine, so you KOSed him. You then killed him and he was a T. Just because BrokeN was there and he wasn’t shooting at him doesn’t not mean that BrokeN is also a Traitor. So both these situations are RDM so I don’t see any need for Darling to be punished.
