Just because doza said he is proven, doesn't mean he can't be KOSed. If you were proven, why not just go into the tester? He claims he gave you ample time to go in, so you should have to avoid being KOSed. wavE did nothing wrong in this situation as you refused to test and he had no proof that you were innocent other than the word of another detective, which can at times be wrong.
