there's been a discussion about this before and it was concluded that if you are 100% certain no one else is there you could kill them.

say you've been in the nether for quite a while and checked every corner, you know for certain no one else is there. Someone comes through the portal and suddenly the trap is activated. You have evidence that it must have been them.

That's not how it happened though. It happened it the first 10 seconds of the round, and I was in nether first as a matter of fact.
