Agreed, but evidence needs to be here to back up his story

What evidence is needed? The staff member says he killed a guy in the tower with a colt, the same story as the guy making the appeal. If you need evidence to prove he saw it happen then how did the staff member get evidence when he gave the punishment that the guy didn't see him.
