A bit of backstory:

Kyber, Nickolas_TheGNAR and I (DaAwezomeViking) were in a teamspeak channel. We are all friends and usually dick around and make jokes (nothing against TOU, just as friends). We were all in a jolly mood and Kyber (as a prank) sent me a link to a jumpscare, knowing that I would be fine with it. He then asked Nick multiple times if he could send it to him, because he knows Nick is sometimes iffy about things and reacts in strange ways (sometimes overreacts). After this, he then went to go read the TS3 TOU because Nick said "You can send it to me as long as it doesn't break TOU". About ten to fifteen minutes after Kyber had asked Nick if he could send him the link, he then asked Nick again multiple times. This was after he had gone to check the TOU. He then sent it to Nick, thinking that it wasn't in the TOU, and Kyber ended up receiving a 1 day ban on TS3.

Please also do note that it does not specifically break TS3 TOU, but rather the regular TOU (It still applies on TS3 as Raeker said 2 or 3 times in the previous post, however obviously when checking the TS3 TOU, Kyber was unaware of this fact).

He meant it as a clear joke and did not mean to break TOU. His clear willingness to check the TOU shows this. He has also never been banned on TS3 (The only time he has ever been banned is when Nick is dicking around and bans him for like 1 second or 1 minute as a joke).

Reason - (What rules did the person break?) Nick did not falsely punish Kyber (the ban is apparently valid, but is very harsh and could've been 1 - 3 hours long), but went extremely overboard with his punishment. (I already stated what rules Kyber broke).
Story - (What happened?)
As a continuation of what I wrote before:
Kyber did not mean to break TOU. It was meant as a joke, and I think Nick took it too far. Although I agree that Kyber has had absolutely atrocious and shit behaviour before, he has definitely improved these last few weeks (I spend a lot of my time on ZARP with him. He has really improved. It's also not just me saying it - others are too). I understand there's a lot of beef with Kyber and Nick, and I'm not saying all their actions in the past should be forgotten. I'm saying that to say "Kyber's had a shit attitude on teamspeak and shit lately" is wrong. He has improved.

Now more on Nick. In the previous appeal Nick said:Here Nick says that I "stated my discomfort". What I said was "Nick I think that link Kyber sent me is an IP grabber". I said this in a more high pitched voice than I usually speak and this was after Kyber had been banned (I assumed Nick had just banned him for 1 second like he usually does. At this time I was also not aware that the link had sound, as it doesn't have any sound for me. WelcomingComic2 also said in the last appeal that he had no sound when he clicked on the link. Just to clarify the link I was talking about was the jumpscare link that Kyber had also sent to Nick). After this I also laughed about it being an IP grabber. There was clearly no discomfort shown by me.

This whole topic raises one of my concerns. Nick was clearly lying in the appeal to save his own ass, saying that "Kyber has been banned before" and "viking showed discomfort". Nick has also fucked up before, for example:

This was my TS3 ban appeal. I will not go into the full story but basically Nick changed the outcome of the appeal saying that there was "further evidence" which he would not disclose with me. I then brought Aek into the situation and Nick had claimed that he had "lost the evidence". I then made a further appeal:

This was because Nick had warned me for "Discrimination" after denying my appeal. This was because he had no evidence and I thought he was lying so that he would not get into shit. He then told Longshot to handle the appeal (for some reason) which put Longshot (A TTT admin for those he do not know) into a very awkward position as he was unaware of the situation and it was his first or second appeal. Johnler then had to step in and resolve the situation.

This shows his unwillingness to help me, his immaturity, his lack of professionalism and him just not giving a flying fuck about me or what I have to stay. This was absolutely the contrary when I asked Bezzy a similar question (As much as I hate to compare I feel like in this situation it is necessary). Bezzy gave me very constructive feedback. Unfortunately I do not have screenshots of this chat.

Nick banned Elmer and Kyber for saying "knickers". I was not in the channel throughout the entire conversation, but it is the British word for panties (Kyber and I had a discussion with Nick about this yesterday). Elmer said "knickers" (I think he was asking "How is knickers loopholing?", however I'm not entirely sure). After this Kyber then asked "How is knickers loopholing?" and then Nick banned him for loopholing.

Extra notes:

This post probably doesn't make much sense, and it probably looks like I just shit on Nick, but I'm trying to bring to others' attention that I don't think Nick is doing his job too well (I am obviously unaware of what is happening behind the scenes and I don't play much on the servers anymore, especially when he is on). From the outside it does not look like he can handle a LT position and he seems quite unprofessional. He clearly is very emotional and biased about his work, and he bans too much (n TS3). This is all I want to say. Thank you.
