I feel like you two really don't know what you're talking about. First of all, it's a clear Terms of Use violation. Now you're saying "You can't expect the users to read that" whilst you're breaking clear rules stated within the community. You're basing your whole argument on rules that you have in fact broken, something you would know if you actually had a brain.

EDIT: Not just that, you're also stating that you said, and I quote: "nig" on multiple occasions. In this community that is classed as loopholing and will still get you punished, even if you don't mean it in a harmful manner.
