There is no limit to breaks/inactivity notices. He clearly needs the breaks and if he feels he can come back and staff he can do what pleases him. Don't try and make him resign because of an issue he can't prevent. Don't hide behind your "disclaimer" either. That was just rude and just a dick way to go around this situation.
